Distance selling contract
1 – Reservation and tour contract
This service agreement is signed by Eldorado Taşımacılık Turizm Tic. Ltd. Yes. (Hereinafter referred to as Coyav Travel.) And the Subscriber with the name and address below (the Customer in this Agreement), www.coyavtravel.com (the “Website” in this Agreement). If the amount If the service for the service is paid to Coyav Travel before the delivery date, the parties will accept it and enter into force.
1. General problems and functions of the service
1.1 In accordance with this agreement between Coyav Travel and the customer, Coyav Travel provides the services shared in the tour details at www.coyavtravel.com (the “Website in this Agreement”) relating to the itinerary specified in the event program with the customer. . The Customer accepts, declares and undertakes to fulfill the obligations set out in this contract.
1.2 The main points of the service to be provided by Coyav Travel in the detailed tour program are the time of departure, the time and date of return and the services contained in the travel description on the website. The services included and not included in the price paid for the tour program are listed in the tour details on the website.
1.3 The detailed tour program is an integral part of this contract and the customer agrees to this by signing this contract for the sale of services.
1.4 Coyav Travel may change the order and time of the places to visit, before the start of the tour or if it deems it necessary during the tour, provided that it falls into the category specified in the tour program on the Website.
2 – Booking and payment conditions
2.1 Reservations and sales become a fact and certainty by reading this contract and the detailed travel programs offered to the client by Coyav Travel from the client, making payment and approval by a Coyav Travel official.
2.2 The customer who books on behalf of more than one person or group is responsible for fully informing about the terms and conditions, the detailed timetable, the other persons to whom he has booked and obtaining their consent. It is accepted that other people know their duties and responsibilities. The customer is responsible for disputes arising from these deficiencies of other persons, Coyav Travel cannot be held liable in any way.
2.3 Payment dates, amounts, methods are listed in each detailed tour program.
2.4 If payments are required to be made in Turkish Liras (TL-₺) instead of a foreign currency, the CBRT exchange rate is used.
2.5 Costs, such as bank charges, service provider deductions that occur differently from the amount of the tour payment that the customer pays during the payment, belong to the customer. The amount to be reimbursed to Coyav Travel is listed on the website.
2.6 Coyav Travel is obliged to take out compulsory travel insurance for the stays of accommodated customers. Due to the fact that it does not exist for tours not exceeding 24 hours, insurance is provided only for accommodation tours. The provisions stated in this insurance contract are valid. If the customer does not find out sufficient insurance conditions of this compulsory travel insurance, he can buy a new insurance separately. However, they cannot request cancellation or refund of premiums by Coyav Travel.
3- Mandatory Changes and Tour Cancellations Arising From Them
 
3.1 Natural disasters (earthquake, flood, fire, typhoon, landslide… etc), emergency situations (war, terror etc.), public movements (strike, walking, road closure… etc), health problems (epidemic disease, quarantine… etc) , extraordinary weather opposition (heavy snowfall and type, fog, severe storm, lightning strike), travel warnings and restrictions of interstate diplomatic problems and tensions, liquidation of any transportation companies and / or hotels that are booked, Coyav for any damages or losses reduced from any negative or unforeseen consequences, directly or indirectly, by Coyav Travel, for any other reasons, including, but not limited to, special restrictions such as bankruptcy, cancellation of planned concerts and events for these reasons. Travel cannot be responsible, but Coyav Travel is responsible for its obligations. Coyav Travel cannot be held liable for material or moral responsibility. For these reasons, Coyav Travel may make changes to the tour or cancel the tour.
3.2 Unlike the agreements between Coyav Travel and all kinds of transportation vehicles, Coyav Travel cannot be held responsible for the delays, breakdowns, accidents, personal defects of its drivers and no material and moral responsibility can be imposed on Coyav Travel. Coyav Travel cannot be held responsible for any changes, delays or cancellations that may occur during flight times. The customer accepts and assumes that any changes and arrangements can be made by the airline company within the framework of international aviation rules.
4- Coyav Travel and Customer Cancellation Conditions
4.1 Coyav Travel does not apply any delay interest if the Customer fails to pay, in case it is not required to delay the payments. However, the customer must complet
the payments up to 1 day before the departure date of the tour, unless stated otherwise in the detailed tour schedule. Otherwise, Coyav Travel reserves the right to cancel this contract unilaterally and will refund all payments except plane, hotel, event and concert tickets.
4.2 Coyav Travel, when it deems necessary, without the consent of the Customer, only on the condition of notifying the Customer, from the tour departure date; It can cancel the tour 1 day in day tours, 1 day in city tours, 1 day before in domestic tours and 15 days before in international tours. In such cancellation, Coyav Travel is obliged to return the fee paid to the Customer. However, the Customer cannot claim compensation due to cancellation. Coyav Travel is not responsible for any damages arising from the upgrade or miles usage of the customer in the aircraft and hotels.
4.3 For whatever reason, the customer will be refunded the full amount he paid if he canceled the tour 2 days before the city tours, 2 days before the domestic tours and 20 days before the international tours. Returns are made within 20 days of notification of the cancellation to the account or credit card paid to Coyav Travel.
4.4 For any cancellations made by the Customer, regardless of the reason after these dates, the Customer undertakes to pay the remaining balance of the tour fee and the payment made so far is not refunded. If another Customer is found to be replaced during this time, the full amount paid will be refunded. Refunds are made within 30 days of notification of the cancellation to the account or credit card paid to Coyav Travel.
4.5 The customer can transfer the purchased tour to another 3 days before the city tours, up to 20 days before the domestic tours and 30 days before the international tours. Coyav Travel is committed to making every effort to extend this period in favor of the customer. The transferee is responsible for the balance along with the transferee, along with the transferor of the costs that may arise from the transfer. Even if the transferee has no signature on this sales contract and forms, it is bound by the terms of this contract.
4.6 The refund amount to the customer is made in foreign currency made to Coyav Travel.
5. Coyav Travel and client defects
5.1 Coyav Travel undertakes to return all money paid to the customer in the event of non-compliance with this contract, except for the reasons stated in Articles 1, 2, 3 and 4 of this contract.
5.2 If the customer confirms that he cannot obtain any of the services listed in the inspection, Coyav Travel will refund the customer the price of the relevant part of the inspection. However, if the customer does not prove his complaint during the inspection, he loses the right to a refund or refund. Complaints or suggestions for improvement after the inspection do not establish a right to a refund or refund.
5.3 The customer is not responsible for payments that are not made on time and for all results that may result from documents that are not delivered on time and completely. In this case, Coyav Travel reserves the right to cancel this contract and the customer’s participation in the inspection.
5.4 The customer undertakes that the information and documents submitted to Coyav Travel are correct and complete. Coyav Travel draws on this information and documents in tourism organizations. The customer is responsible for ensuring that these documents are inaccurate or incomplete, lost, prohibited by judicial or law enforcement authorities for any reason, arrested at the airport, arrested at the airport or at the border, and taken into custody. No refunds or refunds can be requested.
5.5 The customer is responsible for the missing aircraft when the inspection is delayed to the starting point, meets the reasons arising from the inspection and the inspection is missing with a delay to the starting point. The customer cannot in any way hold Coyav Travel liable or demand a refund or refund.
5.6 Coyav Travel is not responsible for the customer leaving the tour due to personal problems or excuses and not wanting to stay at the designated hotel.
5.7 The customer cannot be held responsible for his health problems. He is responsible for assessing the suitability of the road for health and fitness.
5.8 The Hotel is liable for material damage and damage caused by the Customer to the places and vehicles operated and Coyav Travel is not liable.
5.11 All expenses that are not included in the travel fee stated in the detailed tour program belong to the Customer and are obliged to pay.
5.12 The customer is responsible for all valuable documents and items that he has with him or purchased during the inspection. Coyav Travel cannot be held responsible for their loss.
5.13 Tour managers are obliged to provide clear information about the course of the tour. The customer is responsible for problems that arise as a result of hearing, forgetting or knowingly disobeying general notices during the inspection.
5.14 The customer undertakes in advance to comply with the rules of the inspection and program, the rules of the country and place of residence and to respect all other rights
persons on inspection. The customer is liable to Coyav Travel and other customers for any problems or damages caused by non-compliance.
6. Dispute
The provisions of this agreement are subject to Turkish law.
In all disputes that may arise from this detailed inspection program, Coyav Travel’s records will be considered definitive evidence.
The courts of Manavgat and the enforcement authorities are entitled to any disputes that may arise from the detailed inspection program.
